Terms of Service

1. Acceptance of Terms

By accessing or using Koureia ("the Service"), operated by Hypandra, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Koureia is a booking, scheduling, payments, and inventory platform for salons, spas, and barbershops. The Service enables Professionals (salon owners, stylists, barbers, estheticians) to manage appointments, communicate with Clients, process payments, track inventory, and maintain client records including voice-dictated notes.

3. Beta Service Notice

Koureia is currently in early access. The Service may be modified, updated, or discontinued at any time without notice. Features and functionality may change as we continue development.

4. Accounts and Access

4.1 Professional Accounts

Professionals access the Service by creating an account with valid credentials. You are responsible for maintaining the confidentiality of your account information and for all activities under your account. You must be at least 18 years old to create an account.

4.2 Client Access

Clients may interact with the Service through booking flows, appointment communications, and other client-facing features. Client access may or may not require account creation depending on the feature.

4.3 Roles and Permissions

The Service supports role-based access (platform admin, shop admin, team member, client). Each role has different permissions. Shop admins are responsible for managing team member access within their shop.

5. Acceptable Use

You agree to use the Service only for its intended purpose — managing salon, spa, or barbershop operations. You agree not to:

  • Submit false client, appointment, or business information
  • Attempt to access other users' data or other shops' records
  • Use the Service to violate any applicable law or regulation
  • Reverse-engineer, scrape, or programmatically access the Service without authorization
  • Send unsolicited marketing messages to Clients who have not opted in

6. SMS and Communications

6.1 Appointment Communications

The Service may send SMS text messages and emails to Clients on behalf of Professionals for appointment-related communications, including confirmations, reminders, and scheduling updates, when these features are enabled.

6.2 Client Consent

Professionals are responsible for obtaining Client consent before the Service sends SMS communications on their behalf. When SMS features are active, consent is collected during the booking process. Professionals must comply with all applicable communications laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.

6.3 Opt-Out

Clients may opt out of SMS communications at any time by replying STOP to any message. The Service honors all opt-out requests immediately. Opting out of SMS does not affect the ability to book or receive services.

6.4 Message Frequency and Costs

Message frequency varies based on appointment activity. Standard message and data rates may apply depending on the Client's mobile carrier and plan. The Service does not charge Clients for messages beyond standard carrier rates.

7. Content and Data

7.1 Your Content

You retain ownership of information you submit (client records, appointment details, voice notes, inventory data). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process this data for the purpose of providing the Service.

7.2 Professional Responsibility

Professionals are responsible for the accuracy and legality of client records, notes, and other content they create in the Service. This includes ensuring appropriate consent for recording client information and compliance with applicable licensing requirements in their jurisdiction.

7.3 Data Storage

  • Client and appointment data is stored using our cloud database provider (Supabase)
  • Voice recordings are sent to AI providers for transcription and are not retained after processing
  • Transcribed and structured notes are stored in our database
  • We reserve the right to use aggregate, anonymized data for improving the Service

8. AI-Generated Content

Koureia uses AI models to transcribe voice notes and structure them into organized sections. This content is for informational purposes and Professional convenience. Important disclaimers:

  • AI-generated note structures are suggestions and should be reviewed by the Professional
  • Transcriptions may contain errors — always verify against the original recording
  • Client summaries are AI-generated overviews, not clinical or professional assessments
  • The Service does not replace professional judgment or documentation requirements

9. Consumer Health Data

Some services offered by Professionals through Koureia may involve information that qualifies as consumer health data under state laws, including the Washington My Health My Data Act (MHMDA).

Professionals are responsible for:

  • Obtaining appropriate consent from Clients before recording health-related information
  • Complying with applicable state consumer health data laws in their jurisdiction
  • Understanding what information they record may qualify as health data (e.g., skin conditions, allergies, chemical sensitivities)

Koureia does not use consumer health data for advertising or marketing purposes.

10. Third-Party Services

The Service integrates with third-party providers including:

  • Stripe for payment processing, including in-person card payments and saved payment methods
  • OpenAI for voice transcription
  • OpenRouter for AI note structuring
  • Supabase for data storage and authentication
  • Twilio for SMS message delivery
  • Resend for transactional email delivery
  • Vercel for hosting

Your use of these integrated services is subject to their respective terms of service and privacy policies.

11. Service Availability

  • The Service is provided "as is" and may be subject to limitations, interruptions, or restrictions
  • AI features depend on third-party API availability and may be temporarily unavailable
  • SMS delivery depends on carrier networks and Twilio availability
  • We do not guarantee continuous availability of the Service

12. Disclaimers

12.1 No Professional Advice

The Service does not provide professional cosmetology, legal, financial, or medical advice. AI-generated notes and summaries should be used as tools, not as the sole basis for professional decisions.

12.2 Professional-Client Relationship

Koureia facilitates scheduling and communication between Professionals and Clients but is not a party to the Professional-Client service relationship. We are not responsible for the quality, safety, or legality of services provided by Professionals.

12.3 No Warranties

The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Hypandra, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages arising from reliance on AI-generated content, missed appointment reminders, or SMS delivery failures. In no event shall our total liability exceed the amounts paid by you to Hypandra, Inc. in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Hypandra, Inc. and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or connected with (a) your access to or use of the Service, (b) your violation of these Terms, (c) your violation of any rights of another, or (d) Client communications sent through the Service on your behalf.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Service constitutes acceptance of revised Terms. We will indicate the effective date at the top of this page.

16. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
